UNLIMITED LICENSE
OiBeats – UNLIMITED LICENSE TERMS
These UNLIMITED LICENSE TERMS (the “Agreement”) govern the rights granted to any individual or entity (the “Client”, “Licensee”, or “you”) who purchases an UNLIMITED LICENSE from OiBeats (the “Producer”, “Licensor”, “we”, or “us”).
By purchasing or otherwise acquiring an UNLIMITED LICENSE, you acknowledge that you have read, understood, and agreed to be bound by:
- This Agreement; and
- The general GENERAL LICENSE TERMS of OiBeats, which apply to all licenses unless expressly modified here.
This page provides a detailed overview of the UNLIMITED LICENSE tier. If there is any conflict between this page and a separately signed written agreement (for example, a custom deal with a label), the written agreement will prevail for that specific transaction.
1. GRANT OF LICENSE
- The UNLIMITED LICENSE grants the Client the right to use a specific musical composition and sound recording (the “Beat”) for commercial music purposes without limitation on the number of streams or audience size.
- The license is non‑exclusive, which means:
- OiBeats retains the right to license the same Beat to other parties in the future;
- The Beat may, at OiBeats’ discretion, later be sold under an EXCLUSIVE LICENSE or HYBRID BUYOUT, subject to the protections for existing licensees described below.
- The UNLIMITED LICENSE covers the use of the Beat for the creation and exploitation of your own Song(s) (Beat + your vocals/arrangements) but does not grant ownership of the Beat itself.
For general industry context on non‑exclusive beat leasing and unlimited usage models, you may consult educational resources such as the MUSIC LICENSING 101 guide from ASCAP.
2. SCOPE OF USAGE
Under the UNLIMITED LICENSE, and subject to the restrictions listed in this Agreement and the GENERAL LICENSE TERMS, the Client may:
- Record vocals and create one Song using the Beat.
- Distribute those Songs worldwide via any digital or physical distribution channel, including but not limited to:
- Streaming platforms (e.g., Spotify, Apple Music, Deezer, etc.);
- Digital download stores;
- Physical formats (CD, vinyl, USB, etc.);
- Mixtapes, EPs, albums, and compilations (where you control the master).
- Monetize the Song(s) across legitimate revenue channels, including:
- Audio streaming and downloads (subject to distributor/platform rules);
- Monetized video content (e.g., YouTube, Facebook, Instagram, TikTok), consistent with Content ID rules and this Agreement;
- Live performances and performance royalties;
- Sync placements that are clearly within the UNLIMITED LICENSE scope (see Section 7).
- Release unlimited music videos for the Song(s), including lyric videos, official videos, and performance clips.
- Perform the Song(s) live in any venue or event, subject to standard local performance licensing handled by venue owners and PROs.
There is no cap on:
- Total number of streams or plays;
- Number of downloads (paid or free, within legal limits);
- Audience size or geographic reach.
3. OWNERSHIP
- The Beat remains the sole intellectual property of OiBeats. This includes:
- The underlying composition (melody, harmony, arrangement); and
- The original instrumental master recording.
- The UNLIMITED LICENSE grants you usage rights only; it does not transfer ownership of:
- The Beat’s composition;
- The Beat’s instrumental master.
- You, as the Client, own:
- Your lyrics, vocal performances, and any additional musical elements you add; and
- Your Song master recording(s) that incorporate the Beat, subject to OiBeats’ continuing rights in the underlying Beat.
For more information on how underlying works and master recordings are treated in copyright law, see the COPYRIGHT EXPLAINED overview by Creative Commons.
4. PUBLISHING & PERFORMANCE RIGHTS
The UNLIMITED LICENSE allows Clients to treat their Song(s) professionally, including registration with performance rights organizations (PROs) and publishers, as long as splits and credits are correctly reported.
4.1 PRO REGISTRATION
- The Client may register their Song(s) with recognized PROs and publishing administrators, such as BMI, ASCAP, PRS, COSOMA, or their local society, provided that:
- OiBeats’ composer share and publishing share are correctly attributed according to the splits below; and
- The Beat is not misrepresented as solely written or owned by the Client.
4.2 DEFAULT PUBLISHING SPLIT
- Unless otherwise agreed in writing, the default composition publishing split under the UNLIMITED LICENSE is:
- 50% to OiBeats (Producer / Composer);
- 50% to the Client (Writer / Artist).
- This 50/50 split applies to:
- Performance royalties (e.g., from radio, TV, live performance, streaming);
- Mechanical royalties (e.g., for physical/digital reproductions);
- Other composition‑based publishing income (e.g., some sync revenue shares).
- If there are multiple writers on the Client side (e.g., multiple lyricists), they must divide their portion of the publishing among themselves without affecting OiBeats’ share, unless a different split is formally negotiated and approved by OiBeats.
5. MASTER RECORDING INCOME
- Under the standard UNLIMITED LICENSE:
- The Client retains 100% of master recording income from the Song(s) they create using the Beat.
- OiBeats does not claim master royalties under this license tier, unless a separate, written revenue‑share or label‑type agreement is negotiated.
- Master recording income may include:
- Streaming and download royalties paid to the master owner;
- Direct sales of physical or digital copies where you own the master;
- Neighboring rights or master performance income (where applicable and subject to local law).
6. CONTENT ID & RIGHTS ADMINISTRATION
- To protect the Beat and all legitimate licensees, OiBeats may keep the Beat registered with CONTENT ID and other digital rights‑management systems for:
- Identification of unauthorized uses;
- Blocking or monetizing infringing uploads;
- Accurate attribution of underlying rights.
- Where necessary for the Client’s official releases, OiBeats may:
- Whitelist specific channels, distributors, or uploads, so that authorized Song(s) are not improperly blocked;
- Adjust claim administration to reduce conflicts with the Client’s Content ID settings for their Song(s), while still preserving OiBeats’ rights to the underlying Beat;
- Provide key registration information (e.g., work codes, ISWC, internal IDs) on request for proper metadata setup.
- The Client must not upload the Beat alone (as an instrumental) to Content ID systems as if they solely own it, nor attempt to override OiBeats’ legitimate registrations.
For general background on how Content ID systems operate, see the YOUTUBE CONTENT ID HELP CENTER.
7. RESTRICTIONS
The UNLIMITED LICENSE is broad for artist releases, but it is not a universal, all‑media license. Unless otherwise agreed in a separate written agreement, this license does not permit the Beat to be used for:
- Branding or corporate identity (e.g., permanent brand themes, sonic logos, corporate anthems);
- Major advertising or commercial campaigns (TV, web, or large‑scale social media ads);
- Full film, television, or video game synchronization where the Beat functions as a score or key theme (those uses normally require an INDUSTRY/SYNC LICENSE or EXCLUSIVE LICENSE);
- Resale, leasing, or redistribution of the Beat as a standalone product (e.g., beat packs, sample packs, production libraries);
- Rebranding or misattribution of the Beat by claiming you produced, composed, or fully own the instrumental.
Such uses typically require a INDUSTRY/SYNC LICENSE or an EXCLUSIVE LICENSE, depending on scope and context.
8. NON‑EXCLUSIVITY & FUTURE EXCLUSIVE SALES
8.1 NON‑EXCLUSIVE NATURE
- The UNLIMITED LICENSE is non‑exclusive. This means:
- The same Beat may be licensed to multiple artists on an UNLIMITED LICENSE or other lease tiers (e.g., BASIC, PREMIUM);
- OiBeats may continue to sell or license the Beat unless and until an EXCLUSIVE LICENSE or HYBRID BUYOUT is executed.
8.2 EFFECT OF LATER EXCLUSIVE SALE
- If OiBeats later sells or grants an EXCLUSIVE LICENSE or HYBRID BUYOUT for the same Beat:
- Existing UNLIMITED LICENSE holders may continue to exploit the Song(s) they created before the effective date of that exclusive sale, in accordance with this Agreement;
- Their rights are grandfathered and remain valid within the scope of their UNLIMITED LICENSE;
- They may not, however, create new Songs using the Beat after the exclusive sale date, unless permitted by OiBeats and/or the exclusive rights holder.
The later EXCLUSIVE LICENSE or HYBRID BUYOUT applies prospectively, without retroactively cancelling properly obtained UNLIMITED LICENSES.
9. CREDIT
- Where commercially reasonable and consistent with platform standards, the Client agrees to credit OiBeats as:
- Produced by OiBeats, or
- Prod. by OiBeats, or another mutually agreed equivalent credit.
- Credits should be included:
- In streaming metadata where fields are available;
- In video descriptions (YouTube, etc.);
- On artwork or liner notes where production credits are normally displayed (digital booklets, physical releases).
10. TERM & TERRITORY
- Unless terminated earlier due to a material breach of this Agreement, the UNLIMITED LICENSE:
- Is granted in perpetuity (no expiration date); and
- Applies on a worldwide basis.
- “Perpetuity” and “worldwide” here refer to your licensed right to exploit your Song(s) under this Agreement, not a transfer of copyright ownership in the Beat.
11. RESERVATION OF RIGHTS
- All rights not expressly granted to the Client in this UNLIMITED LICENSE or in the GENERAL LICENSE TERMS are reserved by OiBeats.
- Nothing in this Agreement shall be interpreted as a transfer of copyright ownership in:
- The Beat’s composition; or
- The Beat’s instrumental master recording.
- This UNLIMITED LICENSE does not grant:
- The right to resell or sublicense the Beat as a beat, sample, or library asset;
- The right to represent yourself as the original producer or composer;
- Broad sync or branding rights beyond what is explicitly included.
12. SUPPORT & QUESTIONS
If you are unsure whether a particular use is covered by the UNLIMITED LICENSE, or if you need to upgrade to an EXCLUSIVE LICENSE or INDUSTRY/SYNC LICENSE for broader rights (such as branding or major sync), please contact OiBeats with:
