OiBeats – VIP ACCESS SUBSCRIPTION TERMS
These VIP ACCESS SUBSCRIPTION TERMS (the “Agreement”) govern participation in the OiBeats VIP Membership Program (“VIP Access”, “Membership”, or the “Service”). By subscribing to VIP Access, you (the “Member”, “User”, or “you”) agree to be bound by this Agreement, in addition to the OiBeats GENERAL LICENSE TERMS and any other terms presented at checkout.
IMPORTANT: VIP Access is an access‑based membership. It is not a commercial beat license and does not by itself authorize the commercial release of songs over OiBeats beats. To commercially release a track as a music product, you must purchase a separate Beat License (e.g., BASIC, PREMIUM, UNLIMITED, or EXCLUSIVE) for the specific beat.
1. NATURE OF VIP ACCESS
- VIP Access provides Members with:
- Access to a rotating or expanding catalog of OiBeats beats for limited use; and
- Access to sample packs, tutorials, and educational resources created, curated, or owned by OiBeats.
- All materials are provided under limited usage permissions as described in this Agreement. VIP Access does not automatically grant any of the rights included in standalone beat licenses sold on the site.
2. PERMITTED USES OF VIP BEATS (NON‑MUSIC‑RELEASE USE)
Beats downloaded or accessed under VIP Access may be used only for limited creator and content purposes, such as:
- Background music for social media content (e.g., Facebook, TikTok, Instagram Reels);
- Background or intro/outro music for YouTube videos and other online content;
- Music for small business/promotional video content (e.g., social posts, simple website videos), provided the video is not part of a major advertising campaign;
- Personal creative and non‑commercial video projects.
- VIP Members may download beats in available formats (e.g., MP3, WAV) solely for these content‑use purposes.
- These permissions do not include the right to release tracks as standalone music products on streaming services or digital stores.
3. CRITICAL LIMITATION – NO COMMERCIAL MUSIC RELEASES WITH VIP BEATS
THIS IS VERY IMPORTANT:
- VIP Access DOES NOT grant permission to use any beat for professional or commercial sound recordings intended for music release.
- Without purchasing a separate Beat License for the specific beat, you:
- May NOT release songs to Spotify, Apple Music, or any DSP;
- May NOT upload the song as a single/EP/album track to digital stores;
- May NOT sell or monetize a vocal recording as a standalone music product;
- May NOT register the track with distributors as an official release.
To commercially release music (even if you discovered or downloaded the beat via VIP), you must purchase an appropriate BASIC, PREMIUM, UNLIMITED, or EXCLUSIVE license for that specific beat.
4. PERSONAL PRACTICE & DEMO USE OF VIP BEATS
VIP Members may record vocals or experiment creatively over VIP beats for practice and demo purposes only. This is intended to support learning, writing, and rehearsal.
Under this “practice/demo” permission:
- You may:
- Write lyrics and rehearse songs over VIP beats at home or in your studio;
- Create private demo versions to study your performance and progress;
- Share short, low‑quality clips privately with close collaborators for feedback (e.g., private links, non‑public previews).
- You must NOT:
- Distribute the full song publicly as a music release;
- Monetize the recording as a single, EP, or album track;
- Register it with Content ID as if you own the music;
- Register the recording with performance or publishing organizations as a released work.
If you want to turn a VIP practice/demo into an official release, you must obtain a separate Beat License for that beat and follow the applicable license terms.
5. LIMITED CONTENT MONETIZATION WITH VIP BEATS
VIP beats may be used in online video content (e.g., YouTube, TikTok, Instagram, Facebook) under the following rules:
- You may use VIP beats as background or theme music in your videos, including monetized YouTube channels, provided the video itself is the main product (vlog, tutorial, review, etc.), not the music track.
- If a copyright claim arises on platforms like YouTube:
- OiBeats may provide simple usage confirmation or documentation to help clarify that your use is covered by VIP permissions (where appropriate);
- This support applies only to content created within permitted VIP uses and does not convert your video into a full commercial music license.
- VIP does not guarantee that every platform will clear all claims automatically; platform policies vary.
6. SAMPLE PACKS & LOOPS – COMMERCIAL MUSIC PRODUCTION
THIS IS A KEY DIFFERENCE:
- Sample packs, one‑shots, loops, and sound effects downloaded under VIP Access may be used for:
- Personal music production; and
- Commercial music production (e.g., beats you sell, songs you release),
- You incorporate them into a larger, original composition or beat (i.e., they are not released “as is”);
- You do not resell or redistribute the samples by themselves as a competing sample pack or library.
- In other words: VIP sample content may be used in your own beats or songs that you release or sell, but you cannot:
- Repackage the samples and sell/give them away as your own sample pack;
- Upload individual samples to marketplaces as standalone sounds.
Beats and sample packs under VIP are treated differently:
- VIP beats = limited content/practice use (no direct music release).
- VIP sample packs = allowed in personal and commercial music production, but not as standalone sample products.
7. TUTORIALS, COURSES & EDUCATIONAL CONTENT
- Tutorials, guides, and educational videos provided under VIP Access are for:
- Personal learning;
- Skill development;
- Inspiration and reference.
- You may not:
- Re‑upload, resell, or redistribute OiBeats tutorials or course materials;
- Present OiBeats educational content as your own course, product, or paid membership material;
- Strip branding or watermarks from videos for reuse.
8. NO OWNERSHIP, NO EXCLUSIVE RIGHTS
- Downloading any beat, sample pack, or content via VIP Access:
- Does NOT grant you ownership of the beat or sample pack;
- Does NOT grant you exclusive rights;
- Does NOT prevent OiBeats from licensing or selling the same beats or sounds to others (including under standard beat licenses or exclusive deals).
- VIP Access is an access and usage permission model, not a rights transfer or exclusive buyout.
9. SUBSCRIPTION BILLING & ACCESS
- VIP Access is offered as a recurring subscription (e.g., monthly or annual), as displayed at checkout.
- Billing:
- Subscription fees are charged automatically at the beginning of each billing cycle until you cancel;
- Fees are generally non‑refundable, except where required by applicable law.
- Access:
- Remains active while your subscription is in good standing;
- May be suspended in the event of failed payments, chargebacks, or suspected abuse of the Service.
10. CANCELLATION & POST‑CANCELLATION USE
- You may cancel your VIP subscription at any time through your account settings or by contacting OiBeats support.
- Upon cancellation:
- Access to new VIP downloads and restricted content ends at the conclusion of the current billing cycle (no immediate refunds unless required by law);
- Previously created videos that used VIP beats (within permitted uses) may generally remain online, as long as they continue complying with this Agreement;
- You may continue to use VIP sample‑based productions you already created (e.g., beats or songs using VIP samples), but you may not access or download new VIP content after your subscription ends.
11. ENFORCEMENT & MISUSE
- Violation of these VIP Access usage limitations may result in:
- Suspension or removal of VIP access;
- Revocation of usage permissions granted under VIP;
- DMCA notices, takedowns, and other platform enforcement requests;
- Claims for copyright infringement or damages, particularly where beats are improperly released as commercial music without proper licenses.
- OiBeats reserves the right to:
- Audit usage in good faith (e.g., checking major platforms for unauthorized releases);
- Contact distributors or platforms to correct or remove infringing content;
- Refuse future memberships or licenses to users who repeatedly violate terms.
12. RESERVATION OF RIGHTS
- All rights not expressly granted in this Agreement are reserved by OiBeats.
- This Agreement does not override or replace any specific beat license you separately purchase from OiBeats; instead, each beat license adds its own rights on top of your general VIP membership status.
13. SUPPORT & QUESTIONS
If you are unsure whether a planned use of a VIP beat or sample is permitted under these terms, or if you want to convert a VIP idea into a commercial release, please contact OiBeats before publishing.
- Include your username and VIP subscription email;
- Specify the beat or sample pack you are using;
- Describe how and where you intend to use it (video, song release, ad, etc.).
Contact Channels:
- Logged‑in users: submit a ticket via the USER SUPPORT area.
- Visitors / not logged‑in users: use the public CONTACT FORM.
OiBeats will use reasonable efforts to clarify your options, recommend the correct license type if needed, and help you stay compliant while getting the most value from your VIP Membership.
